MEDICAL BILLS?

  • Under Pennsylvania Law, even though you were in a rideshare care, an Uber or Lyft, the medical coverage (also called “no fault” or “personal injury protection”) first goes through your own personal/household automobile insurance. So, you will need to get a medical claim opened with your own auto insurance (your insurance company is not allowed to raise your rates for this, where the crash is not your fault)

NOTE:  If you do not own a car, or do not live with a relative who owns a car and has insurance, then you are able to apply for medical coverage through the Uber or Lyft vehicle in which you were a passenger.   The Pennsylvania required medical coverage for Uber / Lyft is $25,000 in medical.

Levels/Types of Rideshare Coverages (Found at 66 Pa. C.S. Section 2603.1):

1.The Driver of the (Rideshare) car is “offline” (has the Uber or Lyft App turned off)

Then, the Driver’s personal auto insurance coverages apply.  For example, if you are a driver that does Uber or Lyft ridesharing but your app is turned off, then Uber / Lyft coverages do not apply.

  1. The Driver of the Rideshare car is logged into the Uber or Lyft Network (the App is on) in order to accept rides, but a rideshare has not yet been accepted
  • If the driver of the Uber or Lyft car is at fault for the collision, then Uber or Lyft’s coverage does apply (liability coverage: at least $50,000 per person or $100,000 total if more than one person injured)
  1. The Rideshare App is on and Driver of the Rideshare car has actually accepted a ride request, or has a rider in the car
  • If the driver of the Uber or Lyft car is at fault for the collision, then Uber or Lyft’s coverage does apply (liability coverage: at least $500,000 for death, bodily injury and property damage).  Once the ride is over and the customer is dropped off, then the liability coverage goes back to the at least $50,000/$100,000 coverage.

Underinsured Insured Motorist / Uninsured Motorist Coverages While in a Rideshare (Uber or Lyft Car)

If another driver is at fault, but does not have enough liability insurance coverage, then there may be a claim for underinsured or uninsured motorist coverage.   Uber and Lyft recently started waiving these coverages.  So, that means that other avenues of insurance need to be examined.  If you are a passenger, your household or personal auto insurance may have underinsured or uninsured motorist coverage that applies.  If you are the Uber or Lyft driver injured by another uninsured / underinsured driver, then it could depend on whether your are engaged in level 1 (app turned on, no rideshare accepted), level 2 (rideshare accepted or rideshare passenger in your vehicle), or app is turned off.   You will want to speak with an experienced personal injury lawyer.
